How Do Inspections and Investigations Work?

Inspection

The TCFP conducts biennial and risk-based inspections of fire departments and regulated entities to ensure compliance with state laws and Commission rules. These inspections verify:

  • Minimum standards for fire protection personnel education.
  • Proper use and maintenance of protective clothing and equipment (e.g., SCBA, PASS devices).
  • Adherence to standard operating procedures and safety practices.
  • Compliance with reporting requirements, such as firefighter injury data.

Inspections may be unannounced and cover both paid and volunteer departments participating in the voluntary regulation program. The goal is to promote safety and proficiency across the Texas fire service.

Investigation

Investigations are initiated when:

  • A complaint is filed regarding non-compliance with Commission rules.
  • There is evidence of violations of certification, training, or operational standards.
  • Serious incidents occur, such as firefighter injuries or fatalities, requiring review of departmental compliance.

The Commission has authority to:

  • Access records and facilities without prior notice.
  • Issue administrative penalties or corrective actions for violations.
  • Ensure that fire safety inspections and operational practices meet NFPA standards and Texas Administrative Code requirements.
